TERMS OF USE FOR HIGHER, LLC

Welcome to Higher! These Terms of Use ("Terms") form a legally binding agreement between you and Higher, LLC ("Higher," "we," "us," or "our") regarding your access to and use of our mobile application, website, and related services (collectively, the "Services").

By using the Services, you agree that you have read, understood, and accepted these Terms. If you do not agree, do not use the Services.

THE SERVICES ARE FOR ENTERTAINMENT PURPOSES ONLY. HIGHER DOES NOT OFFER FINANCIAL OR INVESTMENT ADVICE OR RECOMMENDATIONS.

PLEASE READ SECTION 18 CAREFULLY. IT INCLUDES A BINDING ARBITRATION AGREEMENT AND A WAIVER OF CLASS ACTION AND JURY TRIAL RIGHTS.

Your use of some features of the Services may be subject to additional policies or terms ("Supplemental Terms"). If any conflict exists between these Terms and Supplemental Terms, the Supplemental Terms will govern.

1. OVERVIEW OF THE SERVICES

Higher offers a non-custodial platform for exploring and trading Solana-based meme coins. The Services include:

• A built-in wallet interface for managing your Solana assets
• Discovery and tracking of trending tokens
• Aggregated swap functionality
• Community features and referral programs
• Educational and entertainment content related to meme coin culture and market trends

The Services integrate third-party protocols (e.g., Solana DEXs and aggregators) but do not host or operate these services directly.

Higher cannot perform transactions or access your private keys. All actions are initiated and signed by you using your wallet. Higher is not a financial advisor, broker, exchange, or custodian.

2. NON-CUSTODIAL DESIGN

Higher does not store, hold, or access your funds, private keys, or wallet credentials. You are solely responsible for maintaining control of your wallet, including any recovery phrases, passwords, or devices. Higher has no way to reset or recover your credentials.
